Terms of Service

These are the terms for using Tsumia (the "Service"). The first sentence of each section carries the key point.

1. Who can use the Service

The Service is available to people aged 18 or over who live in Japan or the United States. At signup you confirm that you are 18 or over and tell us your country.

People under 18 may not register. We may suspend accounts created with false statements.

Other countries and regions, including Canada and Australia, will follow. Until then, use from those places is not covered by these terms.

2. Your account and your keys

Diary text, photos, audio, threads, and interview answers are encrypted on your device before they are stored. The keys that decrypt them (your recovery key and, if you set one, your passphrase) are held by you alone. We never receive or store them.

If you lose both your recovery key and your passphrase (if set), nobody, including us, can restore your diary. Follow the steps shown after signup and keep a printed or handwritten copy of your recovery key.

You sign in with an email address or a Google account. Keeping that email account secure is your responsibility.

3. AI drafting and processing

The Service uses AI to draft diary entries from your photos, voice, and short notes, to produce monthly recaps, and to find threads. Text produced by AI is labeled, for example "AI draft".

Only at the moment AI processes something is the necessary content (the relevant photo, audio, or text) sent over an encrypted connection to the AI platform. It is not stored there afterward and is never used to train AI. What is sent is shown at the entrance of each feature.

AI drafts are for you to review and edit before saving. We do not guarantee their accuracy.

AI acts as the editor of your diary: it drafts, extracts, summarizes, and edits. It is not a conversation partner and does not give advice, evaluations, or diagnoses.

4. Free trial and paid plans

For seven days after signup you can try Premium features free. No card is required, and you return to the free plan automatically when the trial ends. Ending a trial never triggers a charge.

Premium (monthly or yearly) and Founding Member (yearly) are auto-renewing subscriptions charged when you subscribe. The price, renewal date, how to cancel, and refund conditions are shown on the final confirmation screen before you subscribe.

Payments are processed by Paddle.com Market Limited ("Paddle"), the merchant of record. Paddle's buyer terms also apply.

You can cancel anytime from Settings › Plan › Cancel, in as few steps as subscribing. After canceling you keep access until the end of the current period.

5. Founding Member price lock

For the first 100 Founding Members, the yearly price at the time of subscribing stays the same for as long as the subscription renews without interruption.

The lock ends on cancellation, account deletion, or a lapsed payment (after Paddle's retry period). Rejoining is at the regular price.

The lock covers the Founding Member yearly amount only. Plan features may be improved or changed. If the Service is discontinued, the unused portion of the term is refunded pro rata.

6. Prohibited conduct

You may not impersonate others, publish content through share cards or otherwise that infringes others' rights (copyright, likeness, privacy, and so on), tamper with the Service, or use it for unlawful purposes.

You are responsible for anything you publish outside the Service, such as share cards. Get consent before publishing photos or information about other people.

7. Export and deletion

On every plan, including the free plan, you can export your diary, interview answers, and threads at any time as JSON, Markdown, and a ZIP of photos and audio.

Deleting your account cancels any Premium subscription at that moment, with no refund for the remaining term. You can undo deletion for 30 days; after that, all data is erased from our servers. Including backups, erasure completes within 45 days at most.

8. Inheritance and death

Only someone holding the recovery key or passphrase can open the diary. If something happens to you, family members who hold those keys can open it themselves.

Because we do not hold keys, we cannot open a diary without them. On request from next of kin, and after appropriate verification, we will delete the account.

9. Disclaimers and limitation of liability

The Service is provided as is. We do not warrant the accuracy of AI drafts, uninterrupted availability, or fitness for a particular purpose.

Except where caused by our intent or gross negligence, our liability for damages arising from the Service is limited to the amount you paid us in the preceding twelve months.

Nothing in these terms limits the consumer rights you have under the laws of your country or state.

10. Changes and governing law

If we change these terms, we will announce the change and its effective date in the app and by email at least 30 days in advance. If you do not agree with a material change, you may cancel or delete your account before it takes effect.

These terms are governed by the laws of Japan. Disputes are subject to the exclusive jurisdiction of the Tokyo District Court in the first instance, without prejudice to consumer rights under the laws of your country or state.

If the Japanese and English versions differ, the version in the language you chose at signup applies to you.
